ASSUMPTION OF RISK, WAIVER, RELEASE OF LIABILITY, AND INFORMED CONSENT FORM:

1.Waiver Form

You agree to sign a waiver form with Team Thrive.

2. Minimum age

The minimum age for training with us independently is 16. If you are younger than 16, you must attend with a parent or guardian. People under the age of 18 are required to provide a certificate from a parent or legal guardian confirming approval to train with Team Thrive.

3. Your Health

(i) You warrant that you are in good physical condition and you know of no medical or other reason why you cannot or should not do active or passive exercise.

(ii) You recognise that the fitness instructor(s) is(are) not able to provide you with medical advice regarding your fitness, and that this information is used as a guideline to the limitations of your ability to exercise.

(iii) You agree to not hold any certified trainer or directors of Team Thrive liable for any injury that may occur during a Team Thrive session.

4. Can Team Thrive change your agreement?

(i) Team Thrive may sometimes add, change or remove our terms and conditions. This includes changing the opening and closing hours, the Team Thrive services, the facilities, and any membership fees.

(ii) Sometimes, Team Thrive may also cancel or postpone events.

(iii) The most up-to-date terms and conditions always apply. Team Thrive will give you at least 28 days’ notice of any changes. If Team Thrive does not fulfil its obligations to you, you may be able to cancel your membership. Unless the law states otherwise, you won’t have any other claim against us if this happens.

5. Use of your image

You agree to allow Team Thrive to take videos or photos to use for promotion purposes from time to time.

6. COVID-19 Code of Conduct

(i). I will adhere to social distancing and ensure that I follow the reasonable directions of all Team Thrive trainers in relation to my participation in the Team Thrive training sessions.

(ii). I will diligently work to keep all equipment clean following the directions provided

By Team Thrive trainers.

(iii). I will wash and sanitise my hands before and after attending Team Thrive sessions.

(iv). I will not attend any Team Thrive events if I am feeling unwell, including (but not limited to): headache, fever, sore throat, nausea, sneezing, coughing, loss of taste or smell and other cold and flu like symptoms.

(v). I do not have a temperature of 38 degrees, or higher when attending a Team Thrive event. I agree that Team Thrive trainers may check my temperature using a non-contact digital thermometer.

(vi). I acknowledge that if I am exhibiting symptoms referred to above, I may be asked to leave the session for the health and safety of all Team Thrive trainers, members and other participants.

(vii). If I contract or otherwise come into contract with a person who has, or is suspect to have, COVID-19, I will immediately notify Team Thrive and otherwise refrain from attending Team Thrive events until there is no longer a risk of infecting any other person.

By signing below, I hereby acknowledge that I fully understand the above requirements and agree that I will at all times comply with the above requirements. I further acknowledge and agree that nothing in this Code of Conduct is intended to limit my statutory human rights, Team Thrive rules and any waivers or releases I have signed in relation to my attendance of Team Thrive events and workouts.

Team Thrive Health & Fitness Liability Waiver:

7. Informed Consent Form

I, the participant named below, have agreed to participate in the Team Thrive workouts, exercise and training programs (“Workouts”).

I acknowledge and agree that the Workouts:

(i) are a recreational sport activity; and

(ii) may involve strenuous physical activity including, but not limited to, muscle strength and endurance training, cardiovascular conditioning and training, and other various fitness activities.

I hereby affirm, and I affirm each time I participate in a Workout, that:

(i) I am in good physical condition and do not suffer from any known disability or condition which would prevent or limit my participation in this exercise program; and

(ii) I am participating in the Workouts voluntarily and at my own risk.

I hereby release Team Thrive and their officers, agents and trainers (the “Released Parties”) from any claims, demands, and causes of action as a result of my voluntary participation in the Workouts, to the extent permitted by law.

I fully understand that I may injure myself as a result of my participation in the workouts and I hereby release the Released Parties from any liability now or in the future for conditions that I may obtain directly or indirectly from participating in the Workouts, to the fullest extent permitted by law. These conditions may include, but are not limited to, heart attacks, muscle strains, muscle pulls, muscle tears, broken bones, shin splints, heat prostration, injuries to knees, injuries to back, injuries to foot, or any other illness or soreness that I may incur, including death.

Assumption of the Risk and Waiver of Liability Relating to Coronavirus/COVID-19. The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organisation. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people. Team Thrive have done their best to put in place preventative measures to reduce the spread of COVID-19; however, Team Thrive cannot guarantee that you will not become infected with COVID-19. Further, attending Team Thrive could increase your risk of contracting COVID-19.

By signing this agreement, you acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that you may be exposed to or infected by COVID-19 by attending Team Thrive and that such exposure or infection may result in personal injury, illness, permanent disability, and death. You understand that the risk of becoming exposed to or infected by COVID-19 at Team Thrive may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Team Thrive trainers and program participants. You voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to yourself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that you may experience or incur in connection with your attendance at Team Thrive (“Claims”). You hereby release, covenant not to sue, discharge, and hold harmless Team Thrive, its trainers and representatives, from the Claims. You understand and agree that this release includes any Claims based on the actions, omissions, or negligence of Team Thrive, its trainers, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any Team Thrive program.
